Dear Sir or Madam,
My name is xxxxxxxx and I wish to lodge an inquest into the GNIB practices governing the issue of Certificates of Registration, otherwise known as Green Cards, to foreign nationals residing in the State.
The fee for the issue of the Certificate of Registration has been introduced in 2006 by the virtue of the Immigration Act 2004 (Registration Certificate Fee) Regulations 2006 in line with the Immigration Act 2004 (No. 1 of 2004) and the powers conferred on the Minister for Justice, Equality and Law Reform by sections 19 and 20 of the Immigration Act 2004 (No. 1 of 2004). The aforementioned fee is to be paid for the issue of the Certificate of Registration which is granted to authorize the admission of the foreign national subject to a valid work permit issued enabling him/her to be employed in the State.
In line with the Work Permits Act (2006), the Department of Enterprise, Trade and Employment in now authorized by the Minister to issue work permits for a duration of 2 or 3 years or for unlimited duration. Provisions of the Immigration Act 2004 stipulate that the admission of the foreign national is to be given for the period of the leave to remain duration; provisions of the Immigration Act 2004 (Registration Certificate Fee) Regulations 2006 do not propose otherwise.
On the 2nd of August 2007 I have contacted the GNIB Officer based in xxxxxxxxxxxxxxxxxxxx requesting a leave to remain to be corresponding with the duration of the work permit issued for the duration of 3 years (see copy attached). Without prejudice to the work of the local immigration officer which I have known for a few years and have respect for, I have been informed that Central GNIB Office has emailed to the immigration officers country wide instructing leave to remains to be issued only for 12 months and not for the duration of the work permit.
Since I do not find the legal foundation for the aforementioned practices in the Immigration Act 2004 (Registration Certificate Fee) Regulations 2006, nor in the Immigration Act 2004 (No. 1 of 2004), I wish to request an official inquiry into the GNIB practices by the Office of the Minister and wish to be informed in writing of the findings.
